We're getting briefed on the Natural Resource Agencies budgets today ... revenue from the Discover Pass is running $27.9 million less than projected. I really can't say I'm surprised. Nearly everyone who has ever contacted me about the Discover Pass was opposed to it.

I started the day with a Local Government Committee meeting where we took executive action (voted to move bills out of committee) on nine bills. The nine bills were:

House Bill 1049 concerning the administration and operation of flood control districts.

House Bill 1090 increasing the dollar amount for construction of a dock that does not qualify as a substantial development under the Shoreline Management Act.

House Bill 1158 related to the annexation of property owned by the state for military purposes. The title of this bill is a little deceiving, as it only allows the Adjunct General to sign annexation petitions and still requires the normal annexation process be followed.

House Bill 1179 which revises the lien for collection of sewer charges by counties.

House Bill 1185 concerns the equitable allocation of auditor costs.

House Bill 1207 related to the formation requirements for cemetery districts.

House Bill 1217 strengthening the integrity, fairness and equity in Washington’s property assessment system. This is another bill in which the title is misleading. The bill requires appellants challenging the assessed value of commercial property to provide a county assessor with income and expense statements for the three years prior to the assessment date. The statements must be provided to the assessor within 60 days from the appellant filing his or her petition.

House Bill 1239 related to the powers of water-sewer districts. The original bill was very broadly written, but an amendment which passed in committee, narrows the bill considerably.

House Bill 1241 which authorizes water-sewer districts, in addition to cities and towns, to fix and determine the amount of a public works contractor's surety bond and to whom the bond shall run.

I’m in the Government Operations and Elections Committee now where we’re hearing three bills today. House Bill 1162, which is a bill introduced by Rep. Jason Overstreet, enacts the Regulatory Fairness Act of 2013. The bill specifically requires agencies to consider economic impacts when doing rule-making. Amazingly, only State Agencies are here to testify against the bill.

We’re also hearing House Bill 1197 concerning open public meetings and requiring government bodies to accept public testimony before taking action. I agree with the intent of the bill, but when asked for examples of actions that can be taken without public testimony the prime sponsor was able to provide one.

The final bill we’re hearing today is House Joint Resolution 4204 which proposes an amendment to the state's Constitution requiring legislative approval of certain agency rules.

Today in the Government Operations and Elections Committee we’re hearing three bills. House Bill 1078 removes special elections as an option for submission of a ballot proposition to reduce the terms of office of port commissioners. House Bill 1121 creates two house districts within each legislative district and provides for the election of members of the House of Representatives from those districts. Lastly, House Bill 1413 establishes the Washington voting rights act of 2013 to promote equal voting opportunities in certain political subdivisions.

I, along with Rep. Jason Overstreet, have been asked to attend a joint press conference with the Washington Policy Center and National Federation of Independent Businesses today at 3:30. The WPC and NFIB will be discussing the need for regulatory reform in Washington State and highlighting bills Rep. Overstreet and I have introduced.

At 4:00 PM today I will be on KIT to discuss House Bill 1371, the Washington Firearms Freedom Act.

I started my day with a public hearing on HB 1110 to streamline the respirator requirements for asbestos abatement. The hearing went well and I am hopeful we’ll be able to move the bill to the House Floor for passage. I really want to thank Greg Huylor and Jerry Condiff for driving over from Yakima this morning to testify in favor of the bill. A three and 1 half hour drive for a 15 minute public hearing … thanks.

The first bill we’re hearing in Appropriations is House Bill 1067 designed to enhance the basic education allocation formula for principals, assistant principals and other certificated building level administrators to support the teacher evaluation program requirements. The price tag on this bill is approximately $83 million for the 2013-15 biennium.

We’re also hearing House Bill 1226 which addresses the restrictions on collecting a pension in the public employees’ retirement system for retirees returning to work in an ineligible position or a position covered by another state retirement system. It deals with retire-hire of public employees and comes as a recommendation from the Select Committee on Pension Policy.

It’s been a really busy day … after having several meetings with constituents, I’m in the Local Government Committee where we’re hearing three bills. House Bill 1217 supposedly strengthening the integrity, fairness and equity in Washington’s property assessment system. The bill would require people who challenge their property valuation of commercial property to submit pertinent information 30 days prior to the hearing.

House Bill 1239 grants water-sewer districts the authority to exclusively exercise powers that cities and towns have pertaining to permitting, design, construction, inspection, and approval of facilities that are critical infrastructure for the functions of water works and systems of sewerage and drainage. House bill 1241 authorizes water-sewer districts, in addition to cities and towns, to fix and determine the amount of a public works contractor's surety bond and to whom the bond shall run.

Following this committee meeting I have a 3:30 Appropriations Committee meeting to get further briefed on the Governor’s proposed budget.

I started my day with a Government Operations and Elections Committee hearing on four bills. House Bill 1091 which changes the provisions relating to presidential electors to assign electoral votes to the winner of a congressional district. House Bill 1211 is related to providing the public with voter pamphlets for primary elections. House Bill 1278 would require prepaid postage for ballot envelopes. House Bill 1290 is related to requiring county auditors to place ballot drop boxes at colleges and universities at a ratio of one drop box per three thousand students, school district headquarters and high schools.

What an incredible weekend. There were approximately 170 people at the RLC kick-off in Yakima on Saturday. I had the privilege of speaking and we recorded a Freedomcast episode at the event.


It was great meeting so many wonderful people from all over the state. We also attended the Yakima County Cattlemen’s Annual Western Party. They had a huge turnout and it was great seeing so many friends. I was able to spend Sunday with family and friends before heading back to Olympia. God is great!

It’s been a busy morning so far. I started the day recording a radio show with Reps Matt Shea and Jason Overstreet and then spent the next 45 minutes trying to find my wallet that turned out was on the floor at the house I stay out. We had Caucus this morning as well and now I’m reviewing draft legislation in my office. It was must be Monday.

I'm home for the weekend and can't wait to spend the day with Molly. I woke up this morning to a remarkable number of Robins in the pasture ... maybe a sign of an early spring, I sure hope so. I'll be speaking this morning at the statewide Republican Liberty Caucus event, along with Matt Shea and Jason Overstreet. We’re also all going to the Yakima County Cattlemen’s Annual Dinner tonight … I can’t wait to see everyone.

Today has been a fairly easy day in Olympia ... Floor Session and a caucus meeting thus far, followed by two meetings with constituents and the Local Government Committee meeting at 1:30. After a really long week in Olympia, I'm looking forward to being home this weekend.

I stated the day with a Local Government Committee meeting where we heard four bills. House Bill 1074 extends the timeline to allow approval of a final plat (subdivision) application. House Bill 1090 would increase the monetary limit for construction of a dock in fresh water. House Bill 1104 provides jurisdictions to charge fees to recover costs associated with upfront SEPA review. House Bill 1158 would allow the Adjunct General to petition a city for annexation of land used for military purposes. I have concerns with HB 1104 and will be working on amending the bill to address those issues.

We took Executive Action on three bills, House Bills 1013, 1039 and 1074.

I’m in the Government Operations and Elections Committee now and we’re hearing testimony on House Bill 1102 to modify ballot processing provisions to allow County Auditors to count ballots up to midnight on election night. I really can’t believe we have to pass a law to allow this … Can’t a locally elected Auditor choose to do this? We’re also hearing House Bill 1103 concerning uniform ballot design, House Bill 1093 which would prohibit certain types of state agency lobbying activities and House Bill 1195 which repeals some provisions relating to filling unexpired terms.

Here’s a great little"Did you know” … over $4.6 million worth of taxpayer funded lobbying was not reported by public agencies between 2000 and 2009. In 2009 alone, more than $6 million was spent by public agencies for lobbying activities. Is this really an appropriate use of taxpayer funds? I don’t think so.

In the Government Operations and Elections Committee today, we’re hearing four House Bills.

House Bill 1019 requires agencies to make public records available promptly to any identified person and authorizes agencies to require requestors to identify themselves.

House Bill 1037 does four things … one, it authorizes a public agency to obtain information from a public record requestor to determine whether the request is for a commercial purpose; two, it authorizes an agency to charge a fee to recover the cost of furnishing a public record, including an electronic record, where the request is for a commercial purpose and not otherwise exempted; three, requires an agency to establish an appeals process allowing the requestor to appeal the fee amount or the agency's determination that the request is for a commercial purpose; and four, prohibits an agency from assessing the fee if the requestor is a member of news media, a nonprofit organization, an education institution, or a person or entity otherwise entitled to obtain the requested information.

House Bill 1198 requires the Attorney General to develop and implement training programs for the legal requirements contained in the Open Public Meetings Act, the Public Records Act, and the requirements for preservation and destruction of public records and requires members of governing bodies of public and local agencies, elected officials, and public records officers to complete the training courses.

House Bill 1203 removes specified personal information from list of exempted material in certain files and exempts personal information contained in child care and early learning records from public disclosure.

I was able to spend Sunday with Molly and half of the Torres clan. Autumn, Eric and Judah came over for the 2nd Amendment Rally on Saturday and stayed with us. It was great seeing them and nice to be able to sit and chat during the day. Molly left this morning and headed home. It’s going to be a long week.

I’m trying to get the last few bills completed today. I’m waiting on the final drafts for three bills and hope to be able to get those completed in the next couple of days.

Day January 19th - 2013 Regular Regular Lesgilative Session 6

The 2nd Amendment Rally was awesome and really well attended. Here's my speech ...

Good afternoon and welcome to your state capitol. Ladies and gentlemen, we are facing dark times and now is the time for each and every one of us to stand strong to uphold the Constitution of the United States. The tragedies in Colorado, Oregon and Connecticut, and make no mistake these were major tragedies, were perpetrated by bad people, bent on harming good people. Guns don’t harm people, people harm people and no amount of gun laws, gun bans or gun registration will ever stop individuals wishing to harm others. We cannot allow government to use these tragedies to infringe upon our 2nd Amendment rights to keep and bear arms.

In the Declaration of Independence, our Founding Fathers declared that we are endowed by our Creator with certain unalienable Rights. There are two very important points in the Declaration. First, our Founding Fathers acknowledged that these rights came from God, not the Government. Government did not grant these rights and they certainly cannot take them away.

Second, the Founders used the word"unalienable” which means, not to be separated, given away, or taken away. The right to keep and bear arms is not a suggestion. It is not qualified with"unless the government says otherwise.” It is very clear, we have the God given, unalienable right to keep and bear arms.

We have already seen actions that threaten our 2nd Amendment rights and in the coming days and weeks, we will see proposals at the National and State level that will continue the assault on these rights. We all must be ready and stand in support of our rights, we must educate our friends and neighbors when these threats arise and we all must be willing to speak loudly in defense of our rights.

In the next few days, we will be introducing legislation that protects our 2nd Amendment Rights. The Firearms Freedom Act includes a provision declaring"any federal law, rule, regulation, or order attempting to ban or register semi-automatic firearms or any firearm magazine unenforceable in Washington State.

Folks, join me today in telling the government this is our line in the sand and that we will not go quietly into the night.
Join me in telling the government"you will not tread on me.”

The Local Government Committee meeting on the Growth Management Act went very, very well. We had 19 members of the public testify and 17 of them testified about the serious problems associated with the Growth Management Act. Some mentioned specific examples of government taking property rights, others discussed the impact regulations have had on businesses and others spoke about the links to international laws and policies. The testimony was spot on and impactful. I had an opportunity to speak with several of the folks in attendance and thanked them for speaking up.

Its days like today that give me hope and remind me that people support freedom and liberty throughout Washington State.

The first week of the 2013 Washington Legislative Session is almost over and I’m looking forward to the weekend. Although I have a lot of work to do and will be working tomorrow, I do get to see Molly. I’ll be speaking at the 2nd Amendment Rally here in Olympia Saturday afternoon as well. I look forward to seeing everyone there.

I’m headed over the House Floor for Caucus and possible Floor action. I don’t expect there to be a lot of excitement today, but if something breaks I’ll be sure to post it here. The Local Government Committee is holding a Growth Management Workshop today at 1:30 in House Hearing Room D. The 2013 Legislative Session is now four days old and there is very little moving along the process. It's been a strange year in relation to my previous three sessions. Maybe it’s all the pomp and circumstance over the past three days, but the session feels different none the less.

I will be speaking at the 2nd Amendment Rally here in Olympia on Saturday. I hope to see a lot of people from Yakima there in support of our 2nd Amendment Rights.

I’ll be posting today’s Introduction Sheet later today. My goal is to keep people informed as to the bills being considered by the Legislature. We will need people in Olympia throughout the year to help fight to keep our freedoms and liberty intact.

After another hour of pomp and circumstance, Governor Inslee is about to begin his first address to the Legislature ...

Within 1 minute of his speech, Governor Inslee referenced the Sandy Hook tragedy … he could be signaling a desire to expand gun control.

Governor Inslee expressed how proud he is of the passage on Referendum 74 … ugh.

Wall Street is the problem … OR, it could be an over-reaching, over-spending government.

The Governor believes we need economic development and job growth … maybe he’ll endorse a couple of our bills aimed at creating jobs and economic development or maybe not.

Governor Inslee will be proposing a"tradable R&D tax credit to help early-stage companies to develop commercialize their ideas” … interesting concept, only the Democrat Majority has opposed all tax credits and incentives over the past 4 years. Remember the entire"close tax loopholes” argument?

Governor Inslee says"I am serious about reform. In the weeks to come I will be taking action to transition to a results and data-driven government,
with continuous quality improvement, employee engagement, and clear accountability … great, I will be introducing the"Regulatory Freedom and Accountability Act. I look forward to the Governor’s support.

Governor Inslee says"Washington women need the freedom and privacy to make the health care decisions that are best for themselves and their families. That's why I look forward to the Legislature sending the Reproductive Parity Act to my desk, which I will sign” … translation, Governor Inslee demands and will sign mandatory health care coverage for abortions.

Governor Inslee says"Any failure to address the issue of violence in our communities and our schools will be intolerable, and in the coming weeks I will work with the legislature to address this crisis responsibly.”

And then,"I know the sooner we reject the extremes and embrace common sense, the sooner we'll be able to get a public health solution to this public health problem. And common sense tells us that this solution will involve mental health and keeping guns out of the wrong hands, while respecting the right for my son to hunt, and my uncle to defend his home” … I’m not sure what all that means, but I expect we’ll see something from the Democrats soon.

And now Governor Inslee is discussing Climate Change saying"As a parent and a grandparent, I cannot consciously accept the dangers of climate change for my family or yours. As a governor, I can't afford to look the other way or point fingers or deny these realities, and I cannot allow our state to miss the moment we are destined for. All of us in Washington will have to square up to both our responsibility and our opportunity on climate change” … this is not good news for the taxpayers or landowners of Washington.

Governor Gregoire’s final State of the State Address really didn’t include much in the way of good news for the people of Washington. Let me see if I can translate and condense her speech today … we’ve spent a lot of money over the last eight years, revenue is expected to increase by $2.0 billion, the proposed Operating Budget is 7% larger than the previous biennium, and we need higher taxes.

The Governor touted all the wonderful water law that’s been created during her eight years … really?!?!?!? Governor, there are a lot of people still waiting to get a DECISION on a water right, some 30+ years later.

And there it is the words we’ve all been waiting for … Governor Gregoire’s legacy is Gay Marriage. Congratulations Governor, the economy is weak, our citizens are out of work and government is out of control, but you got Gay Marriage passed.

After an hour and a half of pomp and circumstance, Governor Gregoire's final State of the State Address has begun. Here we go ….

After acknowledging all the international businesses in Washington and identifying the great diversity across the state, the Governor reported the State of Washington State is"strong”. Unfortunately, the state of businesses and property owners in Washington is not strong.

The Governor touted the increased funding to K-12 education over the last eight years … wait, I thought we’ve been cutting that. It was a nice acknowledgement by the Governor that simply throwing more money at K-12 education won’t fix it. Oh wait, now the Governor says we have to fully fund a seamless K-12/Higher Ed program. Which one is it?

The Governor says"over the last two years we have funded the largest transportation construction plan in Washington’s history” … but we need more money? Folks, we need to spend transportation money on transportation projects, not environmental compliance.
