March 28th - 2013 Regular Legislative Session Day 74

In the House Appropriations Committee Meeting today we’re considering four bills for Executive Action. House Bill 2002 raises the snowmobile annual registration and renewal fee, beginning 90 days after adjournment of the session in which the bill is passed until June 30, 2014, to $40 and raises the snowmobile annual registration and renewal fee beginning on July 1, 2014, to $50.

House Bill 2016 moves the expiration of the Hospital Safety Net Assessment program from July 1, 2013, to July 1, 2017; continues and increases assessments on hospitals based on non-Medicare inpatient hospital days; replaces increased inpatient and outpatient hospital payment rates with grants, supplemental payments, and increased managed care payment rates; and continues the Health Care Authority's system of quality incentive payments if funds are made available for that purpose.

House Bill 2018 requires the Pension Funding Council to adopt employer-specific additional contribution rates where contributions are made other than immediately after service is rendered, and when the amounts are so insufficient as to otherwise increase contribution rates for other employers or employees within a retirement system.

Senate Bill 5751 requires the Office of Financial Management to compile an inventory of state agency fees and requires the Legislative Evaluation and Accountability Program to publish the fee inventory on its state expenditure information website.

March 28th - 2013 Regular Legislative Session Day 74

My day started in the Local Government Committee where we took Executive Action on five Bills with a"Do Pass” recommendation. The bills were SSB 5399, SB 5417, SSB 5444, ESSB 5656, and SB 5770.

In the Government Operations and Elections Committee meeting today we’re hearing two bills and may consider one bill for Executive Action. Substitute Senate Bill 5381 limiting the use of cellular devices by state employees.

Substitute Senate Bill 5679 to improve the business climate and stimulating job creation by requiring certain agencies to establish a formal review process of existing rules.

The last couple of weeks have been pretty slow here in Olympia, but I expect things to heat up over the next couple of weeks with policy and fiscal cutoffs on the horizon.

March 27th - 2013 Regular Legislative Session Day 73

My final meeting of the day is in the Appropriations Subcommittee on General Government where we’re having a Work Session related to the Military Department. We’re also hearing four bills and may consider two bills for Executive Action. Senate Bill 5052 increases the number of statutorily authorized superior court judges in Whatcom County from three to four.

Senate Bill 5069 increases the number of statutorily authorized superior court judges in Benton and Franklin counties, jointly, from six to seven.

Senate Bill 5516 creates the Criminal Justice Training Commission Firing Range Maintenance Account (Account) in the custody of the State Treasurer; requires moneys generated by the rental of the firing range facilities to be deposited into the Account; and requires expenditures from the Account to be used for maintenance and development of the firing range facilities, property, and equipment.

Substitute Senate Bill 5760 allows the owner of commercial crops to receive compensation for damage caused to the crops by bighorn sheep and directs the Department of Fish and Wildlife to pay crop damage compensation claims in the order they were received, even if the incident occurred in a previous biennium.

March 26th - 2013 Regular Legislative Session Day 72

In the Local Government Committee meeting today we’re hearing four bills and may take Executive Action on eight bills. Substitute Senate Bill 5494 requires existing residential buildings to be equipped with carbon monoxide alarms by July 1, 2014.

Senate Bill 5106 authorizes the county legislative authority, during any period of time that appropriation accounts remain open after the end of the fiscal year, to make transfers, revisions, supplemental appropriations, and emergency appropriations.

Substitute Senate Bill 5444 removes from statute a requirement that county assessors annually assess and send out real property valuation notices for publicly owned property that is exempt from taxation; requires county assessors to value and list certain property that, as a result of a sale or change in use, is no longer exempt from taxation, beginning January 1 of the year in which the exempt status changes; and eliminates a leasehold excise tax credit for certain leasehold interests in publicly owned real or personal property.

Senate Bill 5770 authorizes conservation districts to, on their own initiative, deposit salaries, wages, and other approved financial reimbursements of employees and contractors in the financial institutions of the employees and contractors and exempts conservation districts from a provision that prohibits state offices or political subdivisions of the state from paying employee salaries or wages directly to the financial institutions of their employees unless 25 or more employees have requested, in writing, to receive compensation in this manner.

The eight bills which may be considered for Executive Action are ESB 5121, SSB 5332, ESB 5378, SB 5417, SSB 5494, ESB 5495, ESSB 5656, and 5824.

March 26th - 2013 Regular Legislative Session Day 72

In the Government Operations and Elections Committee this morning we’re hearing two bills and considering seven bills for possible Executive Action. Senate Bill 5411 requires ballot propositions to reduce the terms of office of port commissioners to be submitted for a vote at the general election.

Engrossed Substitute Senate Bill 5577 establishes that knowing acquiescence by a supervisor in the ethics violation of an employee is itself an ethics violation; exempts certain investigative documents and documents related to the identity of the person making an ethics complaint to an ethics board, legislator, or statewide elected official from disclosure under the Public Records Act; modifies provisions governing an ethics board's investigation of a complaint; makes changes to whistleblower protections for state employees and officers, including establishment of a $5,000 civil penalty for retaliation or reprisal; requires ethics training and appointment of ethics advisors for each agency; and repeals a provision giving the subject of an ethics complaint the option of a hearing before an administrative law judge when there is the possibility of a penalty greater than $500.

We took Executive Action to recommend passage of SB 5198, SB 5257, SB 5258, SSB 5507, SSB 5518, and SB 5810.

March 25th - 2013 Regular Legislative Session Day 71

In the Appropriations Committee meeting today, we’re hearing four bills. March 25th - 2013 Regular Legislative Session Day 71

Today marks the start of the final third of the 2013 Regular Legislative Session. My day started on the House Floor where we’re considering Engrossed Second Substitute Senate Bill 5802, which is the Governor’s Climate Change Bill. E2SSB 5802 creates the Climate Legislative and Executive Work Group and commissions a report to evaluate approaches to reduce greenhouse gas emissions. The bill passed 61 to 32 with 5 excused.

What a way to start the week … passing a bill to do something the Governor can do without any Legislative approval. Hey Governor, how about regulatory reform or something to promote economic development? I guess we know what your priorities are, Governor.

March 22nd - 2013 Regular Legislative Session Day 68

Just another example of the different feel this Legislative Session has, there were a lot of committee meetings cancelled this week and there have been several"work sessions” scheduled for next week. I had no committee work today, so I’m working through some budgetary issues. I’m looking forward to seeing Molly and Tiffany tonight … it’s been a long week.

The revenue forecast this week was mixed, so it will be interesting to see what kind and how many tax increases the House Democrat Majority bring forward in the coming weeks. The fact remains the same; the taxpayers of Washington State do not need to send more money to Olympia. The Legislature must return to the Priorities of Government and prioritize spending based on the Constitution.

March 21st - 2013 Regular Legislative Session Day 67

My day started with a Local Government Committee Hearing where we’re taking testimony on four bills and may take Executive Action on five bills. Senate Bill 5417 increases the maximum amount of territory that can be annexed by a code city through legislative action under a specific annexation method from 100 acres to 175 acres and removes certain restrictions on a code city's authority to annex unincorporated "islands" of territory.

Substitute Senate Bill 5494 requires existing residential buildings to be equipped with carbon monoxide alarms by July 1, 2014.

Engrossed Substitute Senate Bill 5656 requires cities that impose a business and occupation (B&O) tax to issue and provide for the renewal of their general business licenses through the web-based Business Licensing Service or "System" (BLS) of the Department of Revenue (DOR) or a city developed portal by July 1, 2016; requires cities that require general business licenses and that do not impose a B&O tax to issue and provide for the renewal of their business licenses through the BLS or a city-developed portal by January 1, 2019; and authorizes delays or phasing-in of the city requirements beyond the July 1, 2016, and January 1, 2019, dates if funding or other resources are insufficient to meet the deadlines or in accordance with other provisions.

Senate Bill 5824 makes numerous changes to provisions governing local improvement districts (LIDs) created by irrigation districts, including: (1) specifying that LID bonds do not constitute a general indebtedness against the issuing irrigation district; (2) authorizing LIDs to be comprised of non-contiguous territory and formed in a neighboring irrigation district; (3) establishing provisions governing what "improvement costs" in an LID must include; and (4) removing an exemptions allowing farm, agricultural, and timber lands to be exempt from special benefit assessments of LIDs within irrigation districts.

March 20th - 2013 Regular Legislative Session Day 66

My 1:30 PM meeting today is in the House Government Operations and Elections Committee where we’re hearing four bills and may consider four bills for Executive Action. Senate Bill 5257 allows the Public Disclosure Commission to readopt certain emergency rules and to adopt emergency rules to implement legislation that takes effect after June 30; changes special reporting requirements from six days to 21 days before a primary election; allows for suspension of personal financial affairs reporting for the term of office of an elected official and up to three years for an executive state officer; and repeals provisions that prohibit large contributions within 21 days of a general election.

Substitute Senate Bill 5518 repeals outdated statutes and corrects language and citations in Title 29A.

Senate Bill 5747 authorizes district-based elections for public hospital districts with a population over 285,000.

Senate Bill 5748 establishes contribution limits for candidates for public hospital district commissioners.

March 19th - 2013 Regular Legislative Session Day 65

My 1:30 PM meeting is in the Local Government Committee where we’re hearing three bills and considering Executive Action on six bills. Substitute Senate Bill 5332 allows fire protection districts to continue imposing benefit charges with a ballot measure approved by a majority, rather than 60 percent, of the voters voting on the measure.

Engrossed Senate Bill 5378 requires that substantial amendments to the State Building Code are not adopted more frequently than every six years.

Senate Bill 5606 establishes the authority of water purveyors to supply fire suppression water facilities and services for cities, towns, and counties, and to recover the costs of providing those facilities and services and provides liability protections for purveyors supplying fire suppression water facilities and services.

March 19th - 2013 Regular Legislative Session Day 65

Please take a look at the latest House Introduction Sheet and pay attention to House Bills 2003 through 2015 … all are title only bills. The Democrat Majority uses"title only” bills as place holders for legislation to be considered later in the session and usually really bad bills for the taxpayers of Washington.

After starting my day with a meeting at 7:30, I’m in the Government Operations and Elections Committee where we’re considering four bills. Senate Bill 5198 removes specified personal information from the list of exempted material in certain files and exempts personal information contained in child care and early learning records from public disclosure.

Senate Bill 5258 requires the top five sponsor identification be listed once the aggregated costs of related ballot measure advertisements sponsored by the same committee total $1,000 or more and clarifies that top five contributor identification is not required to be listed on political yard signs.

Senate Bill 5507 requires that a statement including the Public Disclosure Commission's website be included with each ballot and voters' pamphlet.

Senate Bill 5810 exempts from public disclosure information contained in the security threat group database.

March 18th - 2013 Regular Legislative Session Day 64

I really want to thank everyone who called and emailed the Legislature over the past two weeks voicing their position on several pieces of legislation. I simply cannot express how thankful I am for the support you are providing those of us in Olympia fighting to preserve freedom and liberty in Washington State.

After a nice weekend of sunshine and family, I’m back in Olympia. I taped a radio show with Reps Matt Shea and Jason Overstreet and now I’m in the Appropriations Committee hearing four bills. House Bill 1972 eliminates the Public Printing Revolving Account and transfers revenue and fund balance to the Enterprise Services Account; changes the Enterprise Services Account from a partially non-appropriated account to a fully non-appropriated account; and changes the administering agency for the Personnel Service Fund from both the Office of Financial Management and Department of Enterprise Services to only the Office of Financial Management.

House Bill 1982 repeals the requirement for the State Lottery to conduct a Veteran's Day Raffle.

Senate Bill 5220 requires the law enforcement officers eligible to vote in a Law Enforcement Officers' and Fire Fighters' Retirement System (LEOFF) Plan 1 disability board's jurisdiction to elect a second board member if there are no firefighters under a LEOFF Plan 1 disability board's jurisdiction eligible to vote.

Senate Bill 5287 eliminates numerous accounts and transfers amounts remaining in those accounts to the State General Fund or another account; changes the Enterprise Services Account from a partially non-appropriated account to a fully non-appropriated account; and modifies other provisions relating to several accounts.

March 14th - 2013 Regular Legislative Session Day 60

House of Origin Cutoff has passed and now we’re back in Committee Meetings to consider Senate Bills. My day started in the House Local Government Committee where we’re considering 5 bills. Senate Bill 5002 authorizes mosquito control districts to enter without hindrance upon lands adjacent to lands within the district in carrying out certain powers and duties, and to cut or remove shrubbery or undergrowth to carry out pest control objectives and establishes that mosquito control districts may treat places where mosquitos are found or likely to exist using integrated pest management methods, a process requiring use of the most appropriate pest control methods and strategy in an environmentally and economically sound manner to meet pest management objectives.

Senate Bill 5110 authorizes local governments to award contracts to the lowest bidder before taxes are applied provided that it gives notice of its intent to do so prior to submission of bids.

Senate Bill 5121 establishes requirements related to collector vehicles in provisions governing local government authorizations for the abatement and removal of junk vehicles as public nuisances from private property.

Senate Bill 5186 authorizes water-sewer districts, in addition to cities and towns, to fix and determine the amount of a public works contractor's surety bond and to whom the bond shall run and makes several technical changes, such as removing outdated language and fixing a reference to recodified law.

Senate Bill 5323 authorizes cities and towns to declare by ordinance what is deemed a nuisance within the city or town, to abate any such nuisances, and to levy a special assessment on the land or premises on which a nuisance is situated to recover the costs of abatement and establishes that an assessment levied against property for the costs of abatement constitutes a lien against the property.

After waiting 5 house and 20 minutes for the Democrat Majority to decide what they wanted to do, we passed House Bill 1840 61 to 37 and then broke for dinner. After dinner, we sat around for another 30 minutes and then the day ended.

After a long nine hour day in the Appropriation Committee yesterday, we're starting up again this morning with 2 bills up for hearing. House Bill 1558 repeals the expiration date for the honey beekeeper tax exemptions and provides eligible honey beekeepers with a sales or use tax exemption for purchases of honeybee food.

Substitute House Bill 1693 allows certain new businesses, in computing business and occupation tax due, a deduction of $1 million from the measure of gross revenue for the first 36 months of operations; establishes a statewide cap of $2 million per fiscal year; includes an expiration date of December 31, 2018; requires taxpayers using the deduction to file the annual survey with the Department of Revenue; establishes goals and performance benchmarks for use by the Joint Legislative Audit and Review Commission in reviewing the effectiveness of the tax preference.

We’ll also be considering 20 bills for Executive Action. It will be another long day.
