Less Government, Lower Taxes and More Freedom - 2014 Legislative Session Day 46
We were called back into the Appropriations Subcommittee on General Government and Information Technology Committee to hear testimony on ESB 6149 providing a process for county legislative authorities to withdraw from voluntary planning under the Growth Management Act and SHB 2517 concerning wildlife conflict funding to encourage proactive measures. Both bills may also receive Executive Action.

In the Appropriations Subcommittee on General Government and Information Technology Committee today, we’re hearing seven bills and may take Executive Action on seven bills. ESSB 5045 creating a permit to allow day spas to offer or supply without charge wine or beer by the individual glass to a customer for consumption on the premises.
2SSB 5064 concerning persons sentenced for offenses committed prior to reaching eighteen years of age.
SB 5981 increasing the number of superior court judges in Mason county.
SB 6415 concerning consecutive sentences for driving under the influence or physical control of a vehicle under the influence of intoxicating liquor, marijuana, or any drug.
ESSB 6388 concerning pass-through food distributors.
ESB 6549 -creating demonstration projects for preserving agricultural land and public infrastructure in flood plains.
E2SSB 5540 expanding opportunities to purchase health care coverage from out-of-state carriers.
The seven bills that may receive Executive Action include Senate Bills 5045, 5540, 5064, 5981, 6415, and 6549.

After a long day in the Appropriations Subcommittee on General Government and Information Technology Committee yesterday, we’re back in Committee this morning to hear House Bill 2549 and House Bill 2187. We’re likely going to take Executive Action on both bills this morning as well.

Less Government, Lower Taxes and More Freedom - 2014 Legislative Session Day 17
In the Appropriations Subcommittee on General Government and Information Technology today we’re hearing five bills and may take Executive Action on five bills. Substitute House Bill 1438 creates a new process and new mechanism for calculating annual consumptive quantity for certain water users who have transitioned to a more efficient process for irrigation.
Engrossed Substitute House Bill 1651 provides that juvenile offender records are confidential unless the juvenile has been adjudicated for a sex offense, a serious violent offense, or the offenses of Arson in the first degree, Kidnapping in the second degree, Assault of a Child in the second degree, Malicious Placement of an Explosive, or Leading Organized Crime; the court may release juvenile records for inspection upon good cause shown; provides that confidential juvenile offender records may not be published, distributed, or sold; provides that the provisions of the act are prospective and retrospective; and the act takes effect July 1, 2014.
House Bill 2125 removes the requirement that all fines collected by the Washington Horse Racing Commission (Commission) be credited to the Class C Purse Fund.
House Bill 2156 waives the penalty for failure to display a discover pass, vehicle access pass, or day use permit if the individual proves that he or she owned a valid pass at the time and allows the court to assess administrative costs of up to $25 if the penalty is waived.
House Bill 2307 requires receipts from penalties collected by the Office of Minority and Women's Business Enterprises (OMWBE) be deposited in the Minority and Women's Business Enterprise Account.
The bills that may be considered for Executive Action are House Bills 1438, 1651, 2125, 2156, and 2307.

My final committee meeting of the day is in the Appropriations Subcommittee on General Government and Information Technology where we’re getting briefed by the Department of Corrections. Among the issues being discussed is the DOC budget, implementation of the budget provisions contained in the 2013-15 Operating Budget, capacity and current prison population, and implementation of Senate Bill 6204 from 2012.

April 4th - 2013 Regular Legislative Session Day 81
My only Committee meeting today is in the House Appropriations Subcommittee on General Government where we’re hearing nine bills. House Bill 1888 authorizes the Director of the Department of Agriculture to issue licenses for the growing of industrial hemp; designates industrial hemp as an agricultural product which may be grown, produced, possessed, and commercially traded pursuant to the requirements of the act; creates an industrial hemp account in the State Treasury that is funded by licensing fees; and authorizes Washington State University to undertake research regarding industrial hemp production in this state.
Substitute Senate Bill 5369 recreates the Geothermal Account to receive and direct the distribution of all revenues related to geothermal resource extraction on federal lands located in Washington; updates the existing definition of "geothermal resources" to add specific inclusions and exemptions; and clarifies the relationship among geothermal resource wells and water wells.
Substitute Senate Bill 5289 authorizes the sale of the Discover Pass at a discounted rate for sales, bundling, and partnership opportunities and provides an exception for the Discover Pass requirements for motor vehicles operating on certain roads managed by the Department of Natural Resources and the Department of Fish and Wildlife.
Second Substitute Senate Bill 5540 allows the Insurance Commissioner to enter into reciprocal agreements to allow health insurance policies to be sold across state lines.
Engrossed Senate Bill 5603 establishes the Washington Coastal Marine Advisory Council within the Office of the Governor to serve as an advisory body and forum for communication on coastal marine waters issues and establishes the Washington Marine Resources Advisory Council within the Office of the Governor to coordinate and implement certain activities pertaining to the impacts of ocean acidification through June 2017.
House Bill 2024 provides that the Attorney General is not required to institute or prosecute actions on behalf of state officers against the state or a county in matters regarding the level or sufficiency of fiscal appropriations.
Engrossed Senate Bill 5105 requires the Department of Corrections (DOC) to create a list of approved housing providers; limits payment of vouchers for offenders to the providers on the list, if more than two voucher recipients will be residing per dwelling unit; requires that the DOC limit the concentration of approved housing providers in a single neighborhood and consider a locally created community impact statement before approving a provider; creates a process for local governments to request removal of a housing provider from the list; and requires the DOC to provide transition support to verify that offenders who are using the vouchers in a home with four or more individuals are participating in programs or services.
Substitute Senate Bill 5437 makes it a gross misdemeanor offense (instead of a misdemeanor) to operate a vessel under the influence of alcohol, marijuana, or any drug; provides that any person who operates a vessel is deemed to have given consent to a breath or blood test when an arresting officer has reasonable grounds to believe the person was operating the vessel while under the influence of alcohol, marijuana, or any drug; provides that a person, believed to have committed certain boating violations, could be issued an infraction if he or she refuses to take the breath or blood test upon the request of a police officer; and establishes specific boating safety criteria for any person who has vessels for rent, lease, charter, or use and makes a violation of such criteria a civil infraction unless it is the person's third violation, in which case it is a misdemeanor offense.
Engrossed Senate Bill 5860 provides that the Attorney General (AG) is not required to institute or prosecute actions on behalf of Superior Court judges against the state or a county with respect to fiscal issues and provides that any duty on the part of the AG to continue to prosecute an action on behalf of Superior Court judges ceases after the effective date of the act.
We may also take Executive Action on nine bills … HB 2024, ESB 5105, SSB 5369, SSB 5437, 2SSB 5540, ESB 5603, SSB 5760, and ESB 5860.

My final meeting of the day is in the Appropriations Subcommittee on General Government where we’re having a Work Session related to the Military Department. We’re also hearing four bills and may consider two bills for Executive Action. Senate Bill 5052 increases the number of statutorily authorized superior court judges in Whatcom County from three to four.
Senate Bill 5069 increases the number of statutorily authorized superior court judges in Benton and Franklin counties, jointly, from six to seven.
Senate Bill 5516 creates the Criminal Justice Training Commission Firing Range Maintenance Account (Account) in the custody of the State Treasurer; requires moneys generated by the rental of the firing range facilities to be deposited into the Account; and requires expenditures from the Account to be used for maintenance and development of the firing range facilities, property, and equipment.

Substitute House Bill 1552 creates a licensing scheme for scrap metal businesses; expands criminal penalties for metal theft and malicious mischief; allows for civil forfeiture for any property used in the commission of a crime involving the Theft, Trafficking, or Unlawful Possession of Commercial Metal Property; creates a database by which scrap metal businesses may determine if a potential client has a criminal conviction which makes him or her ineligible to sell property to a licensed business; and creates the Washington Metal Theft Prevention Authority.
Substitute House Bill 1822 requires persons or entities engaged in the business of purchasing delinquent debt for collection purposes to be licensed as collection agencies under the Collection Agency Act (CAA) and to comply with all other requirements of the CAA and amends the list of prohibited practices in the CAA to prohibit the "unauthorized" practice of law, rather than the practice of law in general.
Substitute House Bill 1828 creates a local government fiscal health commission (commission) to identify and respond to financial problems encountered by local government and establishes the commission's authority, powers, responsibilities, and liability with respect to identifying and responding to financial stress in local governments.
House Bill 1924 allows additional, match-free, local watershed planning grants of up to
$50,000 for lead entities or plan implementation groups that commit to conducting a review every five years to ensure that the highest priority issues are being addressed and gives priority to funding watershed planning grant applications that would result in the dissolution of a planning unit if not for receiving the grant.
Substitute House Bill 1375 allows a Group A or Group B water system that could provide adequate potable water for new development if not for the water system's lack of sufficient water rights to consolidate the water system's existing withdrawals with the necessary allowed permit exempt well withdrawals.

February 20th - 2013 Regular Legislative Session Day 38
We’re hearing six bills in the Appropriations Subcommittee on General Government today and may take Executive Action on several bills. Substitute House Bill 1017 establishes minimum energy efficiency standards for battery charger systems, battery backup, and uninterruptible power supplies and establishes minimum water conservation standards for water closets, urinals, showerheads, and various types of faucets.
Substitute House Bill 1060 establishes that, for the purpose of an offender score, an out-of-state felony conviction for which there is no clearly comparable offense under Washington law will be scored as a class C felony equivalent.
Substitute House Bill 1158 modifies provisions governing direct petitions for annexation of unincorporated areas by cities; expands the Adjutant General's authority, with regard to real property owned or used by the state for military purposes, to permit the Adjutant General to file a petition seeking annexation of state military property to a city or town under certain conditions.
House Bill 1159 increases the number of statutorily authorized superior court judges in Whatcom County from three to four.
House Bill 1175 increases the number of statutorily authorized superior court judges in Benton and Franklin counties, jointly, from six to seven.

In the Appropriations Subcommittee on General Government Committee meeting today we’re getting briefed by the Secretary of State, the Washington State Historical Society, the Eastern Washington Historical Society, the Washington State Arts Commission, and the Department of Archeology and Historical Preservation. The operating budget for the Washington State Historical Society is $3.5 million and operating budget for the Eastern Washington Historical Society is $3.2 million. Why exactly does Washington State need two separate historical societies?
We’re also holding two public hearings on bills. House Bill 1613 creates the Criminal Justice Training Commission Firing Range Maintenance Account (Account) in the custody of the State Treasurer; requires moneys generated by the rental of the firing range facilities be deposited into the Account; and requires expenditures from the Account to be used for maintenance and development of the firing range facilities, property, and equipment.
House Bill 1618 designates two categories of building permit fees which are collected by a county or a city and enables the Building Code Council Account to maintain an operating contingency fund of up to six months' average expenditures.
